Did the Supreme Court get it wrong?
This was a good decision by the Supreme Court. As Justice Kennedy said in his opinion, our constitutional rights should not be "contracted away" so easily. If our country is truly at war to bring democracy to the Middle East how can we (with a straight face) deny basic democratic protections to the very prisoners of that war? The lifeblood of our democracy–the rights to liberty and due process–should not be shed so easily. I was proud of McCain for his willingness to speak out against torture despite resistance from the conservative base. Unfortunately he seems to think that indefinitely detaining enemy combatants, without granting them the right to even petition for a hearing, is an acceptable practice for the world's greatest democracy. I can't agree.
